Competition Law

Consumers are afforded a wide variety of rights and guarantees in accordance with Australia’s consumer law. They are entitled to, amongst other things, a guarantee that the product or service is fit for purpose and will last a reasonable amount of time.

Where a consumer has been harmed, or a obligation of a business which provides goods or services has failed to comply with the law, the consumer can seek damages, and the Australian Competition and Consumer Commission can also investigate and take legal action against recalcitrant businesses which breach their obligations under the Australian Consumer Law. The types of issues we can assist consumers with include:

  • Warranty claims
  • Product liability claims
  • Misleading & deceptive conduct
  • Unfair contract terms
  • Fit for purpose issues

Australia has a large, complex field of legislation and regulations governing everything from advertising, investigations and what conduct businesses are prohibited in engaging in, to ensure that consumers and members of the public are not mislead or unfairly taken advantage of. We can assist in a broad range of competition law issues, some of which include:

  • Audits of businesses to ensure compliance with the Competition & Consumer Act 2010 (Cth)
  • Review and advise on advertising campaigns and marketing
  • Australian Competition & Consumer Commission investigations
  • Assistance in the design, preparation and implementation of competition and consumer law compliance policies
  • Drafting and revision of contracts, including standard form contracts for unfair contract terms
  • Representation in ACCC investigations and legal action
  • Competition & Consumer law regulatory issues
